We reserve the right to update these Terms at any time, and we will notify you of significant changes by posting the updated Terms on our website or through other communications.
Use of Services
To use our Services, you must:
- Be at least 18 years old or have legal authorization to enter into agreements.
- Provide accurate and complete information when creating an account.
- Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
- Comply with all applicable laws and regulations, including those related to email marketing (e.g., CAN-SPAM Act, GDPR).
You are responsible for all activities conducted under your account. Outreach Navigator is not liable for any unauthorized use of your account.
Account and Subscription
Outreach Navigator offers free and paid plans (e.g., Starter, Growth, Pro). By subscribing to a paid plan, you agree to pay the fees outlined in our Pricing section. Payments are processed through a third-party payment processor, and you are responsible for providing accurate billing information.
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of the billing cycle. No refunds will be provided for partial billing periods.
User Content
You retain ownership of any content you create or upload to our Services (e.g., email templates, lead lists). By using our Services, you grant Outreach Navigator a non-exclusive, worldwide, royalty-free license to use, store, and process your content to provide and improve our Services.
You represent and warrant that your content does not violate any laws, infringe on third-party rights, or contain harmful or inappropriate material. We reserve the right to remove or suspend access to content that violates these Terms.
Prohibited Conduct
You agree not to:
- Use our Services for illegal purposes or to send spam, phishing emails, or other unsolicited communications.
- Attempt to reverse-engineer, hack, or disrupt our Services.
- Use automated tools (e.g., bots, scrapers) to access or extract data from our Services without permission.
- Share your account credentials with others or allow unauthorized access to your account.
- Engage in any activity that could harm our reputation or interfere with other users' access to our Services.
Intellectual Property
All content and materials provided by Outreach Navigator, including software, designs, and trademarks, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.
Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or fail to pay applicable fees. Upon termination, you will lose access to our Services, and we may delete your data in accordance with our Privacy Policy.
Disclaimers and Limitation of Liability
Our Services are provided “as is” without warranties of any kind, express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or free from viruses or other harmful components.
To the fullest extent permitted by law, Outreach Navigator will not be liable for any indirect, incidental, or consequential damages arising from your use of our Services, including but not limited to loss of profits, data, or business opportunities. Our total liability is limited to the amount you paid us in the 12 months preceding any claim.
Indemnification
You agree to indemnify and hold Outreach Navigator harmless from any claims, losses, or damages arising from your use of our Services, your content, or your violation of these Terms or applicable laws.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in San Francisco, California.
Changes to These Terms
We may update these Terms to reflect changes in our Services or legal requirements. We will notify you of significant changes by posting the updated Terms on our website or through other communications. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
Email Warmup Program
Outreach Navigator's email warmup program enhances your email deliverability by exchanging test emails between consenting users within our platform. These emails simulate natural interactions (e.g., marking emails as read or important) to ensure your outreach emails reach recipients' inboxes.
Key terms:
- Participation requires explicit consent via a double opt-in process during signup or account settings.
- You can enable/disable the warmup program at any time in your account settings.
- Warmup emails are sent only between Outreach Navigator users, with no external or unsolicited recipients.
- We use the
gmail.modify
scope to mark warmup emails as read or important, optimizing deliverability in compliance with Google's policies. - You can view warmup activity in your dashboard and revoke Gmail access via your Google account settings.
- We reserve the right to suspend accounts that misuse the warmup program for spam or unsolicited communications.
Gmail API Use & User Responsibility
By connecting your Gmail account, you authorize Outreach Navigator to use the Gmail API (gmail.send
and gmail.modify
) to send emails and manage warmup interactions on your behalf.
These actions are performed only with your explicit consent via OAuth and align with Google's Limited Use Policy. You are responsible for ensuring email content complies with anti-spam laws (e.g., CAN-SPAM, GDPR). We reserve the right to suspend accounts that misuse the Gmail API for spam or unsolicited communications.
You can manage your participation in the email warmup program, including enabling/disabling the feature and viewing warmup metrics, through your account dashboard.
Refund Policy
Our services are offered through a free Starter plan and paid monthly subscriptions (Growth at $29/month and Pro at $79/month). To maintain the integrity of our subscription-based Software as a Service (SaaS) model and ensure continued delivery of premium features, all payments for OutreachNav services are final and non-refunded, except in specific circumstances outlined below. By subscribing to or using OutreachNav, you agree to this Refund Policy, which forms part of our Terms of Service. We may update this policy at our discretion, with changes posted on our website.
1. No Refund Policy
All payments for OutreachNav's paid plans (Growth and Pro) are non-refunded, regardless of the reason, including but not limited to:
- Changes of mind or dissatisfaction with the service.
- Lack of desired results, as campaign outcomes depend on user implementation and external factors (e.g., recipient responses or email provider restrictions).
- Cancellations or non-renewals of subscriptions.
The free Starter plan is provided at no cost and is not eligible for refunds, as no payment is required. Upon subscribing to a paid plan, you gain immediate access to all features promised, and the value of these services is considered fully delivered at the start of each billing cycle.
2. Exceptions for Billing Issues
We strive to ensure accurate billing, but in rare cases where errors occur, OutreachNav may, at our sole discretion, address the issue as follows:
Billing Errors: If you are charged incorrectly (e.g., double billing or charged for an incorrect plan), you must notify us within 7 days of the charge by emailing support@outreachnav.online with your account details (email used for signup), subscription ID, and evidence of the error (e.g., screenshots or transaction records). Upon verification, we may, at our discretion:
- Correct the error by adjusting your account to reflect the correct plan or billing status.
- Issue a credit for future use within OutreachNav.
- Process a refund to your original payment method, if we determine a refund is appropriate.
Failed Plan Upgrades: If payment is deducted for a plan upgrade (e.g., from Starter to Growth or Growth to Pro) but the upgrade is not applied due to a technical issue on our end, you must notify us within 7 days at support@outreachnav.online with relevant details. Upon verification, we may, at our discretion:
- Apply the intended upgrade to your account at no additional cost.
- Issue a credit for future use.
- Process a refund to your original payment method, if we determine a refund is appropriate.
All requests for billing corrections must be submitted in writing. We will review and respond within 5 business days. Any remedies, including refunds or credits, are at OutreachNav's sole discretion and subject to verification. No cash refunds will be issued unless we deem it necessary or as required by applicable law.
3. Legal Compliance
In jurisdictions where consumer protection laws mandate refund rights (e.g., the 14-day right of withdrawal for distance contracts in the European Union), OutreachNav will comply strictly with such requirements. To exercise legally mandated refund rights, you must:
- Notify us in writing at support@outreachnav.online within the legally required period (e.g., 14 days from subscription start for EU residents).
- Cease using the service immediately upon requesting a refund.
- Provide proof of eligibility (e.g., proof of residence in a qualifying jurisdiction).
Refunds under legal mandates will be processed to the original payment method within 7-10 business days after verification. Beyond these legal requirements, no refunds will be provided.
4. Subscription Cancellation
You may cancel your subscription at any time via your account dashboard under billing settings. Cancellation takes effect at the end of your current billing cycle, and you will retain access to the service until then. No refunds, credits, or proration will be provided for unused portions of a subscription period. Subscriptions renew automatically unless canceled, and it is your responsibility to manage your subscription to avoid unwanted charges.
5. Limitations
- This Refund Policy applies only to payments made directly through OutreachNav's platform. Disputes involving third-party payment providers must be resolved with those providers.
- No refunds or credits will be issued for accounts terminated due to violations of our Terms of Service, such as spamming, unauthorized use, or misuse of our AI tools.
- OutreachNav is not responsible for issues arising from external factors, including restrictions imposed by your email provider (e.g., Gmail or Outlook) or third-party services.
- Transaction fees (e.g., credit card processing fees or currency conversion charges) imposed by your payment provider are non-refunded.
